This Disclaimer governs the User’s access to and use of www.simplemondays.ca (the “Website”), including any content, functionality, and services offered on or through this Website owned by 1001242485 Ontario Inc., a company incorporated in the Province of Ontario, doing business as Simple Mondays (the “Company”). The User agrees to be bound by the terms herein. 

We highly encourage the User to read this Disclaimer, along with our Terms and Conditions and Privacy Policy, before exploring this Website. By virtue of the User’s use of this Website, they will be deemed to have accepted the terms outlined herein. 

NO GUARANTEES

1.1 The Company does not make any guarantees of any level of success that the User may obtain resulting from use of the Website or Platform, through which the Company offers membership services, through paid or subscription purchases. The Company values User success and enjoyment, and strives to provide educational content, but the Company makes no guarantees whatsoever of any results from the use of the Company Website, Platform, products, or services or regarding the availability, accuracy, or reliability of any services offered. The User understands that the Website and Platform do not: (a) guarantee outputs of information and resources that are in curriculum alignment, (b) replace the User’s professional, ethical, and legal responsibilities as an educator, (c) operate as a source of accredited, official, or endorsed educational content, and (d) guarantee the confidentiality and security of sensitive and personal information. The Company does not make any warranties or guarantees as to the prevention of any technical risks such as software bugs or glitches, unforeseen outages, data breaches, unauthorized access, or hacking that may affect the confidentiality or availability of data. The User agrees to use the Platform with discretion.

1.2 The User understands that the Company has not made any guarantees about the results. The Company provides solely educational and informational resources intended to help the User succeed in their endeavours. While the Company makes every effort to ensure that we accurately represent our products and services and their educational potential, through reviews and/or results from previous customers, customers and/or users of our products and services, the Company does not guarantee similar levels of success or potential education and the User or paying customer accepts the risk and full responsibility of their own levels of success and potential education. 

1.3 The Website User and/or paying customer understands that reviews/testimonials and/or results from previous customers are exceptional results from users and are used for testimonial and marketing purposes. They are not intended to represent or guarantee that anyone will achieve the same or similar results. 5.2 By using this Website, the User acknowledges and agrees that the Company is not responsible nor liable to the User should they encounter any negative ramifications that may be financial, physical, mental or emotional in response to or during the use of the Platform or the AI-generated tools and content. The content and services provided on the Website, including but not limited to AI-generated lesson plans, scheduling tools, report card comments, and other curriculum based content and teaching tools are intended for informational and educational purposes only, and the Company makes no guarantees or claims to the outcome, accuracy, availability, suitability, or success of the use of the Platform. The User accepts that they are solely responsible for reviewing, verifying, and using their professional judgment before relying on or using any material produced by the Company services provided on the Website and Platform. 

5.3 The User understands and agrees that the Company is not an educational institution or certified and licensed to provide instructional services, and does not assume any role as an educator, teacher, tutor, school, or educational institution. The User is solely responsible for ensuring that their use of the Website and/or the Platform complies with applicable laws, regulations, institutional policies, and educational standards, including but not limited to those governing student privacy and child protection as required under applicable federal and provincial laws in the User’s jurisdiction, including but not limited to the laws of the Province of Ontario and the laws of Canada. The User has freely and voluntarily chosen to access the Website and/or the Platform, or otherwise engage with the Company and understands that the nature of the products and services requires a certain level of risk and liability. 

5.4 The User acknowledges that they are solely responsible for all liability arising from the unauthorized input of any personal, sensitive, or identifiable information related to students, families, or other individuals, including but not limited to, names, addresses, contact information, or academic records entered into the Platform, that may result in a breach of privacy laws or institutional policies. The User accepts that any harm or injury, physical or otherwise, that is caused as a result of their participation in accessing the Website and/or engagement with the Company or Platform is at their own risk and waives all liability of the Company. The User agrees they are participating voluntarily and understands the risks associated.

LIMITATION OF LIABILITY 

6.1 In no event shall the Company be liable for any actions you do or do not take based on the information on this Website or in any products or services sold through the Website. The User or paying customer understands that the Company will not be liable for any damages based on your participation in using this Website or through your participation and use of any products or services sold or obtained on or through the Website and the Platform. 

6.2 Further, the Company shall not be liable for any injury, loss, death, inconvenience, delay, or damage to the User or the User’s property arising from or in connection with the provision of any products or services offered on the Website, or by relevant third parties. This shall include, but is not limited to, incidents resulting from acts of God or force majeure, illness or disease, war, civil unrest, insurrection, animal encounters, labour disruptions, criminal or terrorist acts, overbooking or changes to accommodations, mechanical failures, or delays or malfunctions of transportation services.

6.3 To the fullest extent permissible by applicable law, the Company, and by extension its owner, and any operators, employees, or contractors of the Company will not be held responsible for any form of damages and/or legal claims against it based out of the User’s participation in using this Website or through their participation and use of any products or services sold through the Website.

SEVERABILITY 

7.1 If any provision of this Disclaimer shall be held to be invalid or unenforceable for any reason, the remaining provisions shall continue to be valid and enforceable. If the Court finds that any provision of this Disclaimer is invalid or unenforceable, but that by limiting such provision it would become valid and enforceable, then such provision shall be deemed to be written, construed, and enforced as so limited. 

GOVERNING LAW 

8.1 Any claim relating to the Website shall be governed by the laws of the Province of Ontario without regard to its conflict of law provisions.
